I work in the retail industry. I am hired on a casual basis but I do full time hours and I am the store manager. I work Thursday nights, Saturdays and Sundays at the same pay rate as weekdays which is $20.90. This is my first job in the retail industry and I have signed a collective agreement. Is a collective agreement legal? I felt if I did not sign it I would not get the position. Should I still be getting paid extra for weekends and late nights?

Hi, My husband was promoted from Storeman / forklift driver to warehouse supervisor. When he asked his boss what the payrise was he was informed at he wa not entitled to an increase of pay as he had negociated a higher pay when he started. We both thought this was unfair but he felt he was not in a position at the time to challenge his boss, however after a meeting with HR last week he resigned at warehouse supervisor due to issues with the boss and was informed he would have to take a pay cut, what we want to know is, 1 was he entitle to a pay rise in the 1st place and was unfairly denied and 2 are they able to cut his pay??? Oh and finaly, when he took over for the warehouse manager was he entitle to higher duties??Cheers

My Partner is a casual employee in a fashion store. she usually works 8.5 hours with any break. What are her entitlements re rest periods and/or a lunchbreak? What action can she take to help her employeer be aware of there entitlements? What can she do if her employeer refuses to comply with industrial requirements.
Thanks
Don

I was told by my boss that life models aren't allowed to work longer than 25 mins without a break (as decreed by whichever union represents us) - yet he and the students often have me in a pose for 45mins or more. If I dare move they complain. How accurate is the 25 min thing? Who monitors and enforces it?

Our "privilage" to drinking water while working on the shop floor has been taken away... is that even allowed?

| Modern Award |

I was employed under the retail trades award but recently converted to a modern award. I have been informed that the new wage is $16.60 per hour but as I was paid $16.28 and my employer has to pay the $26 national wage rise I will be paid at $16.97 for my 38 hour week, all overtime will be based on the base rate of $16.60 and as I now receive an over award payment I am no longer entitled to the $6.25 per week clothing allowance. My questions are; 1. Is this correct? 2. Can you please point me towards the relevant award where a level 2 employee has a rate of $16.60 per hour. Thankyou very much for your assistance.

Hi i was working for a company for 15 months. I injured myself at work in march the same day my boss was diagnosed with brain cancer. I went to doctors, physio and continued to work as i felt this was the right thing to do under the circumstances.. My workers compensation forms were filled in and as i thought logged... I had to fill in my claim forms 3 times as the others were misplaced.. i continued to work even though my injury was getting worse and my stress levels were at an all time high due to not being able to get a straight answer from anyone.. Then after having 1 day of work due to my injury and being asked to make sure i went to work the following day as i was needed, i cracked it and told anyone who would listen that i was leaving to get my injury attended to.. I went to pick up my pay and they had terminated me stating that i had said that i quit.. they have 5 witnessess to agree with them.. Yes i did stat that, but in my defence i stated that as i was in a lot of pain, and was very stressed out, i was going to get myself fixed.. I have applyed for unfair dismissal but am so confused as what to do.. can someone please advise me.. Finding it hard to get a straight answer from any goverment departments.. They all fob me of to the next one.. Im in the to hard basket
