I work as a casual in a call centre and all staff are required to log into workstations 3 - 4 mins prior to shift start in order to be ready to take calls but not paid for this, conversely at the end of the shift have to leave lines open until the clock ticks over but if a call comes in am required to answer and may finish 5 - 15 minutes after end of shift - not paid nor given time in lieu - is this legal?

if I am a casual but have not yet been given a casual employment form to sign other than timesheets and have not been paid yet for the work I did five weeks ago, how late is late and how to handle this as the boss knows everyone wants work and doesn't care if we leave as many fear to complain simply to get however little work they can?

at work they posted up this exact page http://www.fairwork.gov.au/industries/retail/hours-of-work-rosters-and-breaks/pages/breaks.aspx and the General Retail Industry Award 2010 part 5 breaks, my question is if i work 8am to 4pm and im only getting 1 10min break and a 30min lunch should i be getting a second 10min break as stated in that award? im a casual worker in a supermarket and have worked the same exact hours and days for the past 3 years, thanks for any answers u can provide me

For employees that don't use up their sick leave is that something that should be accumulated or does it just get written off? |

| Long service leave |

What is the law in relation to long service leave? I have been in my current job with the same company for over 8 years and wanted to inquire if long service leave is only ever paid after 10 years of service |

I have tried to obtain justice from the South Australian Education Department and the AEU in Adelaide.
I was employed as a teacher and I was the victim of Bullying at the school I was at. I was accused of being the worst 1st year teacher ever amongst other things, including
"It is too painful to tell you about the things that are being said about you"
. Hence I lodged a case for bullying against this "supervisor"; this took nearly a year to resolve. In the meantime an investigation was commenced; allegedly an evenhanded affair?. This resulted in me being abandoned by the AEU's legal person and them refusing to allow me an alternative legal representative: indeed at a later stage they refused to represent me in a case for Worker's Comp. alleging I had only a 10% chance of success. I went ahead and represnted myself at the Worker's Comp Tribunal and won a payout (this took two years). The problem was, that SA Education had blacklisted me prior to accepting reponsibility for creating a health risk during the period in question and still continue to refuse to accept an application for employment even though they were responsible for creating such a scenario: not only that, they have circulated me as being "persona non grata" to the Catholic and States' educational systems. Can anybody please help? |

I work fulltime as a 2nd year apprentice chef, i initially work for an external hospitality recruitment company who sends me out to restaurants to work, but this company i initially am employed by, are hopeless, they never believe their staff when they are being harassed at work (aka me) and i have no leg to stand on. Also I have an injury, which happened at the restaurant that i work at, my boss turned around to me and said that "You're lying, you're just faking this to get attention." I am off work currently, on work cover, my head chef and my boss are ignoring me and don't believe that a) before my injury happened at work i was getting harassed and b) im faking my injury to get out of work, which is incorrect. Where is the fairness and equality? What am i meant to do when no-one believes me? |

My partner works as a chef in a popular restaurant and we just discovered that they are not paying him what they offered at the beginning. The agreement was that he would work 48 hours/week rate at 23 dollars/hour in 5 shifts. So, he has to work a double shift every week meaning he enters at 8 am and leaving at 12 in the night!! with only one hour break (is this legal?) but the main issue is that the restaurant is paying him per week 874 (gross payment) corresponding only to 38 hours of work! They are "forgetting" 10 hours of work and payment. What can he do? Thank you. |

I work full time for a transport company for which im paid on a 40hour week + overtime. My question is a query on there pay method which is they work this out..
Each day is worked out on the following method, they ad the first 8.5 hours off the working day then they minus .5 for lunch each day (which my employer tells me is an 8 hour day)...And for any work i do after that 8 hours is my over time..
Can you please inform me if this is the correct way

I work for a delivery company with around 9 drivers. We have to deliver whenever we receive an order. The worst thing is when we get a half hour for lunch, you're half way through your meat pie and coffee when the boss comes in and says, "there's a delivery to go...NOW !". Is this fair and can he do this because I'm going to do my block very shortly! |
