Made to take Holidays.
Posted by Jack - 11:10 AM 03.06.10
A friend of mine(Plastering apprentice 4th year has completed all tafe courses) has been made to take holidays mid year as his boss currently has no work. He however had plans to take his holidays at the end of the year. Can an employer make his employees when it suits them?

Unfair dismissal
Posted by Sharon - 03:09 PM 02.06.10
My daughter was employed for over 2 years and promoted twice. Each time she was put on 3 months probation without any pay rise. The last promotion came with a promise after the 3 mth probation period however she was dismissed in the late afternoon of the last working day before the probation ceased. She had virtually no training but was due the instant leaving of a fellow employee due to stress. She was competent in the position and had not been given any indication of unsatisfactory work. She was told it was "sort of redundancy" and was paid money, however not enough for redundancy. 12 days later she received in the mail a letter to give to centrelink saying she was dismissed because of unsatisfactory work and was given a golden handshake. She has started "unfair dismissal" against the employer (150 employees) which is going to telephone negotiation on Friday. Any help and suggestions would be appreciated.

Vehicle allowance absorbed into base wage
Posted by Keith - 02:51 PM 01.06.10
I have been requested to sign a new employment contract (under Commercial Sales Award) that lists my base wage as only $26000 per annum plus a $9000 vehicle allowance and a $1000 telephone allowance. Can these allowances be added onto my base salary to then form part of the minimum wage? It does not seem right to me that I should have to use my own vehicle and phone and accrue more personal expenses but to not actually be remunerated to reflect this. Shouldn't I get the minimum wage plus allowances on top of this?

Unpaid
Posted by Shanae - 03:50 PM 31.05.10
My partner worked for 'Fast Eddy's' in Perth for about 5 days before he was dismissed (unfairly). He was never given a contract to sign and when asked what he was to be paid the manager told him he was 'being rude'. He has not received pay for the 4 shifts he worked. When he was dismissed, he was told he was 'not worth the shifts he worked' and therefore was not going to get paid. This dismissal happened AFTER the day he was supposed to get paid for the first 3 shifts, which to me says they never had any intention of paying him. During the shifts he did work he was not allowed to the time to wash his hands between picking up rubbish, washing tables, taking out the bins and serving food, plus his breaks were cut in half. My main question is, how does he go about getting the pay he deserves? What is his best option?

The company I work for has recorded a performance review for me when none was done. Other staff actually got a performance review and a pay rise in response. Can I do anything about it ?

Pay rise's
Posted by Nicola - 10:15 PM 30.05.10
Hi, I'm seventeen and have been employed as a casual employee for Subway for a little over a year. My current pay is still the same as what I started on, which is $7.22 an hour, and I don't recieve any extra's on weekend's or public holiday's. I was unsure if turning seventeen meant I was entitled to a pay rise, as I asked my boss but she just said she didn't think I should get one for turning seventeen even though one of the other emplyoee's who is younger than myself has had two pay rise's and is on more than $10 an hour and has only been working there a few more months than myself. A lot of the other employee's that work here are also concerned about getting paid their fair pay but none of us know what we can do about it. I was wondering if you could tell me if I deserve better pay or what I could be doing about it please?

Roster Change
Posted by Chris - 05:53 PM 30.05.10
A change in Roster has been proposed for a long time with a few different ones suggested but the one we're forced to trial for 2 mths is the one management want. In an 8 week cycle it only gives 2 weekends off & both are one after another so 6 weeks until the next weekend off. There are also at least once a week & sometimes twice where there are quick turn arounds (finish at 11 pm & start again at 7am the next day) There are also weeks where there are 3 differesnt shifts within the week. Can they legally do this? I would have thought there would have to be at least a 10hr break between shifts & more than 2 weekends off in 2 mths. Thanks for reading.
