I have a friend who worked with my company for over 10 years .when New owners came, They reduced his hours and he left the workplace. Now i found that he had ten years long service leave due two weeks after his departure. What i wantto know is, is long service leave an entitlement that is entirely up to the descretion of the employer? or is he entitled to recieve what was owing inmoney?I was told in confidence so i cant tell this man until i am sure of the facts. He is disabled and I feel he was unfairly treated

Predator corporation on vulnerable workers
Posted by Peta - 12:10 PM 26.03.10
My son has a slight intellectual disability and has been working several hours per week for two and a half years. He has not been paid a cent since leaving school two years ago, so work experience is no longer valid. They managers use a disability label to deny him any pay whatsoever. My son gets very down when others get paid. His job is equal to that of his fellow workers unpacking new CD stocks, sealing and distributing CDs to various music genres on shelves. I plead for the ACTU to help my son of twenty develop some dignity and respect. No wonder this Corp is making massive profits!. Can you help him he's a great young man with so much potential. How can he be helped to receive monies owed to him and stop this victimisation? Peta.

I have worked for a business for the past two years 3 days per week (same days and hours) and have an ABN number. Recently due to lack of work, I have been given short notice, e.g 7.30pm the night before, that I am not needed the following day. I hold a senior position and fill in for the office manager when she is on holidays. I do not have an oportunity to get work for the following day. They tell me I am only casual and they can do this. What are my rights?

When I resigned my boss found out who my new employer is and called them to give my new boss his personal opinion of me (bad of course). Is he allowed to do this?

Part Time: Set roster?
Posted by Aerie - 08:15 PM 25.03.10
My hours have been cut to 15 per week due to a reduction in wages allocated to each store. Am I legally entitled to a set roster as a Permanent Part Time employee? I am looking for a second job so that I can get by, but my hours change week to week, meaning I can't know when I am available for other work. I have had to turn down one job already because of this issue, and don't want to have to turn down another, or fear clashing hours. If I know when I'm working in my first job week to week, then I know what other days I can offer to another employer.

Unfortunate switch
Posted by Zaki - 07:48 PM 25.03.10
Hello, The situation is as follows. a) I was a research assistant in university A since September last year. b) I was going to get a Masters scholarship in January from university A. c) My lecturer (supervisor) was contemplating on moving to university B at the same time but didn't know when it would happen. d) I was told to get a scholarship from university B in November but was rejected. e) An agreement on moving between my lecturer and university B was achieved early March. e) He managed to get me a scholarship starting from March. d) From January to February, I was not a staff of university A. f) I was doing my usual masters work from January to February and most of that work is for a grant. g) I was told in March that I wouldn't be getting any money for January and February. However, since I did some work for a grant, he could get some funds from that grant. h) In order for this to happen, it has to get approval from the head of department and since my lecturer and I are leaving, my lecturer said chances are slim as he is also losing influence in the university. What can I do? I wish that my scholarship started on January and I wouldn't have lost 2 months of funding since we students don't even earn much. I appreciate the help.

is this fair?
Posted by Maddie - 06:17 PM 25.03.10
I've had a casual job at Bakers Delight for about 9 months, the employer has recently hired 7 new staff to replace the full time worker who is taking leave. I am the only staff member that isnt new that has not been employed there for more than two years. Earlier this week I recieved a phone call saying that I was not going to be rostered on anymore because my availablity was too complicated. She also blamed me for turning up late to a shift, which I was told I did not have. What are my rights? Can I fight for my employment? Is know there are very few rights for casual workers.... but there has to be SOME.

Expected to work on a weekend in my time no pay or offering of Time in Lieu
Posted by Julie - 09:54 PM 24.03.10
I've been working FT with this company for about 2.5 years and recently in the last 8 months was promoted to a higher position in sales. A couple of weeks ago we had an Exhibition our company decided to display at and myself and the other employee were expected to work a full 9.5 hour day with a half hour break. The problem is there was no discussion on how the were going to rewrd us for this as it was outside our expected working hours. When i approached the matter and asked how it would be treated i.e as a normal day with pay /or as a day in lieu the boss said "i don't know why you are asking as it is an expectation that you work without pay and without a day in lieu" Is this right?? Surely not...
