Employment Agreement or Modern Award?

The employer has given me an employment agreement and told me I wont get paid until its signed. The agreement contains some covenants relating to restraint of trade, confidentiality and copyright. How do I get a review of my individual full time employment agreement? Do I need to sign a contract at all when I am covered by the modern award?

I've spent a lot of time of late trying to establish whether or not my 20yr-old daughter is being ripped off or not. But it seems there's no easy way of telling. For over 2 years now she's worked for the same employer, where, when, and how he says, but since he "doesn't want the hassle of paperwork" she has to submit an invoice for him to pay each week, at a rate HE decided - a massive $18 per hour. No annual or sick leave entitlements, no superannuation. And no written contract of any kind. Is this "yeah, you can have a job - just give me an invoice at the end of the week" kind of thing the way of the future for our young people?!? So far as I know, this guy has 4 or 5 young people working for him, pays no PAYG on their behalf and they don't cost him a cent in Superannuation. Is it just me, or was it that these things used to be a lot more black and white?

I wrote a week ago about how I was accused of cheating on my time sheet and contradicting my boss. I have just had 3 days off work with the flu and am going back tomorrow. My boss emailed me at home and asked me to cancel my outreach appointments organized for tomorrow and come in to the office. when I asked why I received no response. I'm concerned this may be due to me taking sick leave and I'm anxious about another confrontation without knowing what it is I'm being called in for.

my wife is currently in a very stressful situation at her workplace she has recieved a written final warning for bullying which is laughable she is the victim of a girls club she was sat in an office with 2 leading hands the manager and on the phone from sydney a personal manager .apparently they had a meeting prior to this to work out their game plan my wife sat in that meeting in shock and when she was asked questions she was totally beside herself in the end they had their minds made up it didnt matter what my wife said they wouldnt listen to her my wife is one of the most truthful hard working people i know im not biased i just know her work ethic is very high they have no right to do this she hasnt recieved the minutes of the meeting even though she was told she would when they gave her the written warning she was given 5 minutes ti read it and sign it and get back to work how can we deal with this she has been sick ever since this started she has worked st the job for over 3 years starting work at 5am and working 9 hour days can someone please help noone deserves this treatment

I had bully by my team leader at work and i had brought the attention to my manager, but he ignored, what can i do, should i go to Hr or should I go to my manager boss? before go to HR

Contractor rights

My husband has been contracting to the same company on a fulltime basis for roughly 10 yrs. They only will pay him 2 weeks after he puts his invoices in, and alot of the time, doesnt pay him, due to them being on stop credit, they say the contractors can wait!! Also is my husband meant to pay his own super and tax, as he only ever does work for the same company

I needed a clarification of the MA000100 Social Community Homecare Award. I am a casual and the award states at clause 25.2 that casuals who do not work 38hours per week are not entitled to weekend penalty rates IN ADDITION TO their casual loading. I have tried to get a definitive answer but I only get an interpretation. I read this as you don't get both weekend penalty and casual loading. I have been told it means if you work less than 38hrs you are not entitled to any weekend penalty rates. Should not the wording in the award clearly state casuals who do not work 38hrs will not be paid any weekend penalty rate. Thank you for any clarification.

Worksite Rep

I received advice from my union (ANF) that my application for position as Worksite Rep had been approved by Union. I was the ONLY applicant for a position that had been vacant for six months, and applied for the position as no one else seemed interested and members were being "Counselled" during Worktime, being pulled away from Patient Care to be formally interviewed over sick leave taken. The Management have refused to accept My position owing to the fact that "They didn't get to vote on my applicant", as the sole candidate, for a position which had been vacant for six months. Subsequently, I have been refused leave to attend annual delegates conference, the Job vacancies adverts specify five days educational leave per annum, of which I have received one day in 2009. Does the Union Appointment Stand, or am I being made to look foolish?
