i've been employed for nearly 3 years now.Last year i asked for my holiday pay and been paid only for last year.Can i still ask for the holiday pay for the first year(2007)Do i really have to ask for it or i should be paid in the end of tax year if i didnt go for a holiday???

There’s quite a bit going on here so we really need to ask you few questions to get a clear picture. Can you  phone us on 1300 486 466 (1300 4 UNION)?)

I am working as a sales person at one of the big companys seling vacuum cleaners in Melbourne for more then 2 years. My boss is OK with me, but some of the staff members do different types of hurassment and intimidate me. It`s all because of my non australian backround, my not so strong English as australian people speak and my skin colour. But, all this my languages skills and my asian skin colour not disturb me to do my work well. My boss is happy with me about my work and try to solve all the problems. But some of my collegs do that again and again and I know who is arranging all this-the aussi woman who who is incharge and my boss he is living in Australia for a long time but He has non australian backround. So this 55 y.o. aussi woman push people to harass me and intimidate me. What can I do to protect myself at my work place.

Have been working as Rn in Private hospital for12years.They have cut the shift hours to6 hrs to save money on the overlap.Not all staff,as we all do various hours.I want to know is this fair.I now have to work an extra day,as the hours wers 8hrs before.

Annual leave?

My partner has been employed full time with benefits with his employer for the last 10 months. We recently booked a holiday for which he was going to use his accured annual leave (approx 2 weeks). He put in a written request with 3 weeks notice. The management shortly after gave him a correct form to fill out rather than just the paper he had typed on. By the time this form was handed in the company still had an ample 2 weeks notice. We are meant to leave for overseas in 7 days but have just been told his leave has been refused due to lack of notice. We are very angry as nothing was mentioned in the first stages of request and it is too late to cancel flights and accommodation now. The company does not have a union representative so we don't know what action to take from here as he will likely lose his job if he goes but we will lose thousands if we don't. Please help! :(

I am a newly appointed clothing retail manager (previously casual of 12 plus years with same employer) working 5 days, 35 hours per week in charge of 3 staff (up to 14 during sales). My hourly rate has decreased but is consistent with current award. I work overtime and would like to know my entitlements when working over my agreed hours. Currently I receive 25% extra on Saturday and double time Sundays, which I only work during busy periods. I thought I should get time and half for first three hours of overtime and double time thereafter, inclusive of the Saturday. I haven't signed my contract as they have not included my correct title of Store Manager, classification or that I am paid my half hour lunch to compensate for opening and closing store. Will my classification change on July '10 and will my wage increase under the Modern award? MA000004/AP796250

When do I get paid after a public holiday?

I am a casual for a retail company and usually get paid on a Wednesday. However if there is a public holiday which falls on a Monday my pay goes in a day late, my question is are they allowed to do this?

Dock pay from employers

I am a yoga teacher and the employer/contractor where i work will dock the employee/instructor $5 per person if we forget to add customer details into the system or for the amount the till is down at the end of the day is this legal. We all invoice him and so are not technically employees?

I have been a victim of emotional abuse by my boss. For a time I was called "Woman" instead of my real name, he would go through my bins and would imitate me whenever I spoke and alot of other irresponsible issues also went on. He paid me in cash and gradually every week he was cutting me back $2 sometimes $4 each time, I have no proof of this as he supplied me with no payslips or EFT. He, I think, he has cut back my super as well. This is my first year into the work force after finishing school, I am very confused about what my rights are and I feel as though something needs to be done. Because of his lack of respect to me (and other employees) I have lost alot of self confidence.

Work injury dispute

I had a work related injury back in 2004 and my employer Australia Post accepted my claim. Since then i have been to numerous Doctors they have sent me to and also other specialists i have had surgery and been told by the Surgeon that my condition will just get worse with time Now my situation is that have been working closer to home for about 2 1/2 years and i have 3 Specialists that agree i should not drive to my normal workplace 1 hour and 10 min away because it keeps exacerbating my symptoms. And 1 of the Doctors of their choice say that i should have no problem doing it. So after that i got directed to start once a week at my normal work place and i asked for a internal appeal and of course i lost.. So now i have been struggling with going once week to my normal work place unable to drive back home and has left early a couple of times because of severe pain and to even be able to do that i have to take panadine forte. So now of course they have upgraded me to two days a week and my Doctor says i am unfit to do so but i have been told that the last determination still stands despite my Doctors certificate. I have a Solicitor and i am going to appeal this at the AAT but that takes time. I have lost a lot of my income because of this and i am getting very worried because i have family 2 young children if they keep upgrading me and i cant do it i will have no income.Is there anything i can do about this?
